@Tom Scott A major point you neglected is that there's confusion about the difference between copyright infringement and plagiarism. Copyrights and patents should last only as long as is necessary to establish who the original author is within their relevant community. 12 years is an absolute maximum.

While I found your video quite a fair explanation on Copyright Infringement, your quick dismissal of "video game streaming" culture as little kids who would scream and shout if they couldn't stream, is quite dishonest. Video game developers and publishers aren't paying $10k PER HOUR to a streamer because they like their content infringed on. Streamers are active advertisement, and the industry has mostly seen the benifit of it. Not just because the viewers are little kids.

"Horrible gamer children"? Look the only time you could make an argument for streaming negatively impacting video game sales, is if we're talking about a visual novel (but that opens the can of worms about whether or not VNs can really be called games). Or maybe if your game is absolutely terrible but your marketing department is great and you only want to be a "one and done" type of company. Now as far as streamers being able to earn money off of it, that's a bit more debatable.

Not relevant to the video, but I've seen Stock Image companies claiming that historical, public domain photos where theirs. Not for a false copyright case to get money from others, but to trick people who don't knoe any better into paying them "for the right" for these public domain protographs.

Regarding the 20 year patent law, that is why we now have household 3d printers. The technology was patented 30 years ago (well, the common technology, called FDM or FFF. Others were patented later on). When it expired in 2009, amateur 3d printing started to blossom. This is my take on it. The Reprap project has existed since 2005 so one could argue. But this still is a very fair point - if patent laws in the US had been 70 years maybe it'd take until 2059 to make FFF printers legally.

I haven't finished watching yet but somewhere along the 30m mark reminded me of an anecdote Years ago, a photographer was shooed away from a street because someone in charge of the building they photographed claimed the building was copyrighted. The building. Is copyrighted. Against photographers on the street. So naturally when Tom went out to the street I was wondering... (Opera building, Tel Aviv, no idea whether that had any basis to it but if anyone is that curious I can dig up blog posts people made about it. There was some retaliation and a small photography protest event)

Copyright is nothing more than a government decree for a monopoly of a specific type and pattern of speech. To wit, it is a direct violation of free speech. It is a logical inconsistency. You either have free speech or you don't. You can't have it both ways. That's the real reason why copyright is broken.

I think YouTube's copyright system IS broken, but given the legal framework it's built on, how could it be otherwise? On the subject of Public Domain, I just want to point out the film "It's a Wonderful Life". That's a wonderful film, but it would have been destined for obscurity if it never went into the Public Domain (for a time, at least). Putting things into the Public Domain, or at least giving people a license to use your IP without charge or overly restricting it, can be a good way to get it out there.

Some idiots just see photography up for grabs, but I will take action... issued 2000 DMCA takedowns this year alone on Accounts using my pictures to seell them as prints, to sell their merchandise and get more followers for promotions... I am so sick of it... (I do not go after non commercial use, just the ones that use my stuff for free)

I love you Tom, you have made some amazing content and videos over the years and many of your ideas could change the world for the better. But this is one where I am afraid you are wrong. why should anyone be able to take your ideas and creations as long as you live? How about treating copyright just like patents? The creator having to actively apply for copyright, having to prove their work is new and original and having to pay a fee to the authorities. Meaning, the public would get a financial compensation for works that are not in the public domain. Would that be bad for arts and culture? No. To me, an artist has to be in it only for the act of inspired creation itself and not for the money. If that means an end to all pop music, so be it.

The reason people we’re angry over the oli thing was because the sample from warner chapel WAS FAIR USE it was a very short clip (used for about a second) and as it was changed so much it counted as fair use (as far as i know)

Looks to me like youtube's copyright system is still broken, but given the legal foundations underneath it may not be possible to build a content sharing site without a broken copyright management system. And a less broken platform copyright system would be very expensive to operate.

The example of copyrighted material that bothers me the most is that the Wizard of Oz movie from the 30s is still under copyright protection. Therefore, ruby slippers, and the green skin witch, which are not in the book, are not fair use. And that was almost 90 years ago!

I've been saying it for years to people complaining that youtube is broken for demonitizing people, just like you say in this video. Do you know how expensive it is to host videos??? Youtube is a free damn service for hosting unlimited videos. You're lucky you even get that, so don't complain if their content ID system is a bit shite and you don't make bank on every video you upload for free to this free service.

Saying that a recording of gameplay is not fair use makes me think of a world where taking photos/videos at Disney World (or similar places driven by copyrighted content) could be disallowed by law because a majority of customers would have very similar experiences and it may prevent some people from paying to see it in person since they can get the gist of the experience for free. People go to theme parks because it is something you have to participate in to get the full experience and I would argue it is the same with watching a video game recording vs playing it yourself. Media, such as shows and movies, are designed with no interaction in mind so the entire experience is simply just viewing it. An exception would be something like Black Mirror: Bandersnatch where viewer interaction is the defining component and the reason for it being such a big deal compared to the traditional movie/tv experience. Also, the point about watching a video game to get the idea of it or to see how the story unfolds hindering the profitability of said game is ludicrous. If it wasn't for people playing games and uploading it online, giving these companies/people free advertisement, sales would decrease because the overall interest would be lower and a majority of sales for any given video game is highly reliant on interest alone. There are companies like Nintendo who will copyright strike gameplay because they want to curate who delivers these impressions onto others and is likely why there is a smaller amount of successful Nintendo fans that can sustain a Youtube channel by playing mostly Nintendo titles compared to companies like Activision-Blizzard who openly allow their content to be played by everyone on all the biggest platforms.
